Chapter 6 - Service of Process

The sound was not the tentative tapping of an Amazon delivery driver, nor the polite chime of a neighbor. It was the heavy, rhythmic pounding of law enforcement.

Chloe’s high-pitched voice echoed from the top of the stairs: “Mom! Who is that? I’m recording my audio!”

Gwendolyn scowled, tossing the pen back onto Samuel’s desk. “Stay here and finish signing. It’s probably the furniture delivery for the studio.”

She smoothed her silk blouse, pasted on her patronizing smile, and marched toward the grand double doors of the foyer. She pulled open the heavy oak door, her smile already forming.

“Yes? Can I help—”

The words died instantly in her throat.

Standing on the covered porch were two uniformed deputies from the Maricopa County Sheriff’s Office Civil Enforcement Unit, their ballistic vests emblazoned with gold lettering, their service belts heavy with equipment. Flanking them was Jonathan Vance, impeccably dressed in a charcoal three-piece suit, his silver hair combed back, his expression as cold and merciless as a winter gale over the Grand Canyon.

Behind Jonathan stood a licensed process server holding a thick, blue-backed legal docket, and two commercial locksmiths equipped with heavy toolkits.

“Gwendolyn Sterling?” the lead deputy, a broad-shouldered sergeant named Martinez, asked in a flat, clinical tone.

Gwendolyn stepped back instinctively, her hand fluttering to her throat. “Yes… yes, I’m Gwendolyn. What is the meaning of this? Why are you at my home?”

“This is not your home, Mrs. Sterling,” Jonathan Vance stepped forward, his voice carrying the terrifying authority of forty years in high-stakes estate litigation. “I am Jonathan Vance, legal counsel for Paige Sterling, the sole Trustee and fee-simple owner of the Oakridge Estate.”

Samuel emerged from the den, his face completely drained of color, his Montblanc pen still clutched limply in his right hand. “Jonathan? What… what are you doing here?”

“Serving you with reality, Samuel,” Jonathan said, refusing to even look at him with warmth.

Sergeant Martinez stepped into the foyer, his heavy boots clicking sharply against the polished Spanish tile. He held out a thick document.

“Samuel Sterling, Gwendolyn Sterling, and Chloe Mercer. You are hereby served with an emergency Notice of Immediate Termination of Equitable Life Tenancy, an Order of Revocation of Permissive Occupancy, and an Ex Parte Temporary Restraining Order issued two hours ago by Judge Katherine Ross of the Maricopa County Probate Court.”

Gwendolyn’s eyes bulged. Her southern drawl vanished, replaced by a screech that could shatter glass. “What? Are you insane? This is my husband’s house! He owns this property! We have lived here for nine years! You can’t just walk in here with the police and hand us some bogus paperwork!”

“Read the document, Gwendolyn,” Jonathan said calmly, pointing a manicured finger at the docket in the deputy’s hand.

“Under Arizona Revised Statutes Section 33-1371 and the explicit terms of the 2010 Elena Vance-Sterling Irrevocable Trust, Samuel’s life tenancy was conditioned entirely upon the uninterrupted, peaceful occupancy of Paige Sterling. Last night, at approximately 7:42 PM, you unlawfully, constructively evicted the sole fee-simple owner of this real property by threatening her with expulsion if she did not surrender her designated quarters.”

Jonathan produced an iPad from his leather briefcase, tapped the screen, and turned the volume to maximum.

The foyer filled with Gwendolyn’s own venomous voice, echoing through the high ceilings:

*“Either give your master bedroom to your sister by tomorrow morning, or pack your bags and leave this house forever. I am done with your attitude! This is my home too, and tomorrow your bedroom belongs to Chloe. If you don't like that, leave!”*

Gwendolyn frozen. Her mouth hung open. Her skin turned a sickly shade of ash gray.

“You recorded me?” she gasped, her voice trembling with sudden, hysterical terror. “That’s illegal! That’s an invasion of privacy!”

“Arizona is a one-party consent state, Mrs. Sterling,” Jonathan said with chilling precision. “Paige was a party to the conversation. The recording is fully admissible, authenticated, and has already been entered into the judicial record under an emergency affidavit of waste and constructive eviction.”

Chloe came running down the stairs, her phone still in her hand, her eyes wide with shock. “Mom? What’s going on? Who are these people?”

“Furthermore,” Jonathan continued, turning his gaze toward Samuel, whose knees looked as though they were about to buckle beneath him, “we are fully aware of your fraudulent attempt to encumber this property through Apex Capital Holdings. We have the preliminary title inquiries from Marcus Finch. We have the Ring surveillance footage from 1:15 PM today of Gwendolyn and Chloe actively discussing using fraudulent loan proceeds to purchase a luxury vehicle and pay off outstanding court judgments.”

Samuel let out a choked, dying sob and collapsed against the foyer wall, sliding down until he was sitting on the Spanish tile with his head in his hands.

“Oh God,” Samuel wept. “Oh God, Elena… what have I done?”

“You have exactly seventy-two hours to remove your personal effects, Samuel,” Jonathan Vance declared, his voice dropping like an iron portcullis. “The locksmiths behind me are here right now to change the exterior deadbolts on the perimeter and re-key the master suite. At the expiration of seventy-two hours, any individual remaining on these premises will be arrested for Class 1 criminal trespass.”
